1. Introduction

Welcome to JupiterAI, a platform developed by JupiterAI Inc., a Florida-based technology company. By accessing, browsing, registering for, or using our Services, which include but are not limited to web-based software, applications, content, and support systems, you acknowledge that you have read, understood, and agreed to be legally bound by these Terms of Service and our Privacy Policy. If you do not agree, you must refrain from using the Services immediately.

2. Scope of Services

The Services provided by JupiterAI are primarily designed for commercial use by licensed law firms, particularly those engaged in property insurance litigation and plaintiff-side representation involving commercial, fire and smoke, water and flood, or wind/hail and catastrophe-related claims. Our platform also supports professionals in the roofing and solar industries. JupiterAI provides software-based tools, claimant matching, automation services, and integrations that support lead generation, intake efficiency, and client engagement. Legal users of the platform are solely responsible for all legal evaluation, representation decisions, and case outcomes.

3. Eligibility & Account Responsibility

You must be at least 18 years of age to use the Services. If you are accessing the Services on behalf of a law firm, you represent and warrant that you are authorized to bind that firm to these Terms of Service.

All payments are facilitated by Stripe, a secure third-party payment processor...

7. Confidentiality of Case and Claimant Information

All information shared with JupiterAI in the course of claimant generation — including but not limited to claimant identity, property damage claims, contact details, and case-related notes — is treated as strictly confidential. JupiterAI does not sell, license, or otherwise share claimant data with third parties, except as required to facilitate core platform operations such as lead routing, CRM integration, automated communication, or technical infrastructure maintenance.

JupiterAI enforces role-based access control, activity logging, and internal confidentiality agreements to protect customer and claimant data at every stage. We do not use data shared with one law firm to enrich or support any other firm’s services. For law firms, any claimant-related data shared through JupiterAI may include legally sensitive or privileged information. While JupiterAI does not access legal strategy or correspondence, all information processed through our system is treated with the same care and confidentiality as legally protected data.

8. Data Processor Status for Legal Use Cases

To the extent that JupiterAI processes personal data on behalf of a law firm or its clients, JupiterAI acts solely as a data processor, processing such data only under the instructions of the subscribing law firm, which serves as the data controller. JupiterAI shall not use such data for any purpose other than providing the services agreed upon and shall not process such data in a way that contravenes applicable data protection laws, including the GDPR and U.S. state-level privacy statutes.

JupiterAI agrees to process legal-related personal data in a manner consistent with applicable attorney advertising laws, the ABA Model Rules of Professional Conduct where relevant, and any confidentiality obligations as required under your local jurisdiction.

9. Territory Exclusivity and Data Segregation

For active monthly subscribers (including those on the Monthly Legal Flow or Elite Claim Surge plans), JupiterAI enforces territory exclusivity based on ZIP code coverage. During an active subscription, no other firm may receive claimant data originating from a reserved ZIP code or overlapping area of exclusive service. Claimant leads are never cross-shared or duplicated across competing firms in violation of these exclusivity rules.

Exclusivity ensures that claimant introductions and associated lead intelligence are not shared with competing firms operating in the same region, which is essential for maintaining competitive boundaries, ethical case origination practices, and the integrity of firm-specific case strategy.

Starter Pack users do not receive exclusivity guarantees.

10. Lead Authenticity and Legal Outcome Disclaimer

JupiterAI uses internal verification processes to screen for underpaid or denied property claims and to reduce the occurrence of invalid or duplicate leads. However, we do not guarantee the legal validity, winnability, or acceptance of any particular case. All legal evaluation, claim prosecution, and client representation decisions are the sole responsibility of the subscribing law firm. JupiterAI does not provide legal advice or assume liability for litigation outcomes.

Claimant qualification is not a substitute for legal due diligence. Law firms are expected to conduct their own case intake review, jurisdictional screening, and legal validation before engagement.

11. Data Security Measures

JupiterAI uses bank-grade encryption, SSL/TLS certificates, and secured cloud infrastructure to protect all transmitted and stored data. Access to sensitive systems is controlled through secure authentication, IP restrictions, and internal audit controls. We also comply with industry best practices to ensure the confidentiality, integrity, and availability of data shared with us.

While JupiterAI is not a HIPAA-covered entity, we follow many of the administrative, technical, and physical safeguards recommended in the ABA Cybersecurity Handbook, and we remain committed to data minimization, access auditing, and breach response protocols.

12. Data Usage & European Residents

If you are located in the European Economic Area (EEA) or otherwise subject to the General Data Protection Regulation (GDPR), you have certain rights regarding your personal data, including access, correction, erasure, and objection to processing. JupiterAI may rely on legitimate interest or contractual necessity to process lead-related data unless local law requires additional consent.

13. Cookies, Tracking, & Analytics

JupiterAI uses cookies, web beacons, and local storage tools to improve functionality, monitor performance, and understand user behavior. These technologies help us optimize the platform experience and ensure efficient claimant-to-client matching. You may adjust your browser settings to manage cookie preferences.

14. Consumer Opt-Out and “Do Not Contact” Compliance

JupiterAI supports and respects consumer privacy choices. If a claimant opts out of SMS, email, or phone communication, their contact status will be immediately updated and suppressed across our messaging workflows. Claimants may opt out at any time via standard reply codes (“STOP”) or by contacting [email protected]. JupiterAI complies with TCPA, CAN-SPAM, and relevant “Do Not Contact” laws and will not transmit leads to clients that violate opt-out preferences.

Law firms using the JupiterAI platform are responsible for adhering to all applicable consent and contact laws within their jurisdiction. JupiterAI provides opt-out mechanisms and contact suppression tools to support your compliance efforts but does not assume legal liability for downstream misuse or unauthorized messaging by clients.

15. Third-Party Tools

Third-party tools may collect or process data under their own privacy policies. JupiterAI only integrates with trusted services and limits data exposure to the minimum necessary for functionality. Clients are responsible for reviewing and managing their third-party platform settings.

20. Recordkeeping, Data Retention, and Legal Hold

JupiterAI retains lead data, communications, and user activity logs for a period of 24 months, unless otherwise required by law or upon customer request. We support compliance with legal hold requests and subpoenas issued by courts of competent jurisdiction. Upon termination of service or legal request, JupiterAI can securely export and/or delete customer data as required under the applicable privacy law or contract.

21. Indemnification

You agree to indemnify, defend, and hold harmless JupiterAI Inc., its officers, affiliates, and employees from and against any and all claims, liabilities, losses, damages, costs, or expenses — including reasonable attorney’s fees — arising from: (a) your misuse of the platform; (b) your failure to comply with applicable laws, including privacy, telemarketing, and advertising regulations; (c) disputes between your firm and claimants introduced via JupiterAI.

25. SMS Messaging Consent & Data Protection

JupiterAI may use text messaging (SMS) to communicate with users who explicitly opt in to receive updates, alerts, support messages, or service-related notifications.

By submitting your phone number through our website or forms, you agree to receive recurring automated text messages at the number provided. Message and data rates may apply. Message frequency may vary.
You may reply HELP for assistance or STOP to opt out at any time.

Your SMS opt-in data and consent will never be shared with third parties, except for our authorized message delivery platforms and aggregators (e.g., Salesmsg or telecommunications providers) who assist in message transmission.

Your phone number and any data collected through our SMS communications are stored securely and handled in accordance with:

  • The Telephone Consumer Protection Act (TCPA)
  • 10DLC registration compliance (U.S.)
  • General Data Protection Regulation (GDPR - EU)

26. Colorado Consumer Privacy Rights

Residents of Colorado have specific rights under the Colorado Privacy Act (CPA). If you are a Colorado resident, you may:

  • Request corrections to your data if it is inaccurate
  • Request deletion of your personal data
  • Opt out of the processing of personal data for purposes of targeted advertising or profiling

We are committed to complying with the Texas Data Privacy and Security Act (TDPSA), which became effective July 1, 2024. If and when applicable, Texas residents will have the right to:

  • Access and correct inaccuracies in their personal data
  • Request deletion of personal data
  • Opt out of the processing of personal data for targeted advertising or profiling
